According to the always educational Ron White, if 3 people say they saw you kill someone in Texas, it's good enough to ride the express lane for a death penalty.

So all the eyewitness reports say he hit the gas, I kind of think it happened. Especially since the video we are able to see also includes the sounds of someone hitting the gas at exactly the time you think he may have hit the gas, and a car reacting in such a manner as well(thus why he was hit with the back tire).

To me, I'm surprised people are even trying to debate otherwise in the face of all this.

Tony hit the gas. You can hear it on the camera and you can see his car react in a manner consistent to that.

Every witness I've seen talk about the incident also states Tony hit the gas.

If you gotta defend Tony, just say he hit the gas trying to avoid or something and please stop insulting the intelligence of other people.

1. Yes he hit the gas, its how you control a sprint car. Not hitting the gas while you are going around a turn leaves you going sideways straight into a wall.

2. No you do not hear his engine. The only way you hear his engine is if you were there on the side of the track the accident occurred. If thats the case, where is your statement to the police.

3. Every person I have seen talk about it who has experience in a sprint car in a dirt track has backed Tony. I have no dog in the fight, I personally don't like racing. I do like facts though, and you are just spewing crap, none of it based on facts.

It's in the video, pretty clear. And eyewitnesses have made plenty of statements to the same effect.

Has backed Tony in what way? That he didn't do it on purpose and would never actually hurt the kid on purpose? I agree with that.

Have they backed Tony in meaning that he wasn't trying to scare the kid and sling mud on him/brush him? Well that would be a lie because the driver a few cars in front of Tony in the race it happened thinks otherwise.

I have and it's still speculative.

I may be speculative and I'm not saying I would vote him guilty based on the evidence presented, but it's what I think is the most likely thing that happened.

Still, it has to be gut wrenching for Tony.

I just read the breaking news. From the start, I thought this would be the likely outcome.

According to Ontario County District Attorney Michael Tantillo, Ward was under the influence of marijuana during the race.

Tantillo said "two dozen" people were interviewed in the case and revealed that toxicology reports determined that Ward had marijuana in his system.


"There is toxicology evidence in the case related to Kevin Ward, that actually indicated at the time of operation that he was under the influence of marijuana," Tantillo said. "There was no toxicology work performed on Tony Stewart, however a certified drug recognition expert had interviewed him on the night of the collision and determined that he found no basis to observe any alcohol consumption or impairment by drugs."


When asked about Ward's toxicology reports, Tantillo said that the amount in his system was "enough to impair judgment."


Tantillo also said that there was no evidence of "aberrational" driving from Stewart before he hit Ward and that it appeared Stewart was driving in a straight line until he hit Ward. Two videos of the accident were used as evidence in the investigation.


"Those videos were examined in detail. They were enhanced. They were run through programs that allow the frames to be isolated," Tantillo said. "They were run at 75, 50 and 25 percent speed. They were overlaid with grids and data and they were pretty important piece of the evidence here.


"The videos did not demonstrate any aberrational driving by Tony Stewart until the point of impact with Kevin Ward, at which his vehicle veered to the right, up the track as a result of the collision. Prior to that his course was pretty straight."

According to Tantillo, the grand jury was considering two charges: second degree murder and criminally negligent homicide.

I would like to know what "under the influence" means.

Did he just fire up before going out on the track?

Or was it from 2 days before.

It's like when they nailed Canuckistanian snowboarder Ross Rebagliatti at the Limpics for the herb.

Nobody tested the curlers who would have tested positive for rye and coke.....
