Lou is one of the guys who has always been a big supporter of the league brass. Same with Brian Burke. Allies like that aren't forgotten. It's also why he's gotten away with some sketchy stuff before.

Now that whole not giving up the Matteau pick makes sense. Gives us a lot more flexibility this summer as to what we can do, who we can trade, what type of packages we can come up with. Big relief, even if it is the 30th, it's still a higher end talent as opposed to our first pick being a mid 2nd rounder.

Good, let them be mad. That wasn't the first of such contracts and the league decided to make an example of the Devils.

I'm surprised, but I think the right decision was made. And, it has nothing to do with the fact that Kovalchuk retired to me.

The Devils may have been the most flagrant with the frontloading type contract, but they were certainly not the first to clearly take advantage of the language of the prior CBA. At that point, there were no specific restrictions on frontloading contracts, only a vague rule about cap circumvention. Punishing the Devils for it and not other similar deals just didn't make sense. Two wrongs don't make a right.

Kovalchuk retiring may have helped pushed the league into making this decision, but I honestly wonder how big a factor it played.

i agree dabs. i wonder if the devils did appeal the decision they would be getting their original pick back. i dont get why fans are upset or even care. its the 30th pick not the top 10 we would've got if we miss the playoffs.

I wouldn't be surprised if he did, but he's certainly not going to say anything. Each of the last two drafts there were rumblings that the Devils had a deal in place to not lose the first.

i'm happy we got the pick back. but since we will never know the whole story (if lou knew he would still have it) it was still stupid of him to keep the 29th pick. i will never change my mind on that. heck even now it looks a little stupid. keeping the 29th pick so you can lose a top 10ish pick this year?

well thats what i dont get. i'm reading everyone is in lou we trust mode again. but why? he "lucked" into the nhl caving on the penalty. when if he just gave up the 29th pick we could possible be in a lotto position right now? we can't trade the 30th pick in the draft

if the devils miss the playoffs we basically kept the 29th and it cost us a chance at the #1 pick since everyone who misses can now win the lotto. yeah we get the 30th pick but was it really worth it?

How do we know this wasn't an ongoing thing and there wasn't an understanding between the 2 sides though? Like why would the NHL wait until after the trade deadline to inform him? They probably said if we give you this pick you can go and immediatley flip it.

NEW YORK -- The National Hockey League announced today that it has decided to modify the disciplinary sanctions originally imposed on the New Jersey Devils' franchise for its conduct in connection with the signing of former NHL Player Ilya Kovalchuk in July 2010, which conduct was determined by an Impartial Arbitrator to have constituted a circumvention of the NHL/NHLPA Collective Bargaining Agreement (the "CBA") then in effect.

The sanctions originally imposed on the Club included a significant fine, the forfeiture of the Club's third-round draft selection in 2011 (which was forfeited) and the forfeiture of a first-round draft selection which has been deferred by the Club until this year in accordance with the terms of the original penalty. As a result, as it relates to the portion of the discipline relating to the first-round draft pick, the Devils stand to forfeit it entirely in the upcoming 2014 NHL Draft. The Devils recently applied to the League for reconsideration and relief from a portion of the original penalty, citing primarily changes in circumstances which, in the Club's view, changed the appropriateness of the sanctions initially imposed. After due and thorough consideration, the League has decided that a modification of the original circumvention penalty associated with the Kovalchuk contract is warranted and, accordingly, has amended the sanctions as follows:

The New Jersey Devils will now be entitled to the 30th selection overall in the 2014 NHL Draft (the last pick in the first round), regardless of the Devils' final standing following the 2013/14 season.

The Club will not be permitted to trade or transfer its right to the 30th overall selection in the 2014 NHL Draft.

The Club's fine has been partially reduced.

The League intends to have no further comment on this matter.



so i guess lou didn't know in 2012 that he would get this pick back. he got lucky the nhl reconsidered the penalty

He had to have known something when he didn't forfeit the 29th pick. He just never tells people anything. The appeal had been sent in a while ago and I would suspect the NHL wasn't going to comment or proceed with the appeal until the labor agreement was sorted out. If you recall, Lou and the Devils never commented or acted on the vetoed contract. The entire saga was a big sham between the NHL and the labor union. The arbitration hearing and penalties were in big part posturing for the following year's labor talks.

it sounds good cap but we will never know if thats how it went down. just like all other conspiracy theories. lou gambled by taking the 29th pick and instead of losing out he hit zero on the roulette wheel and got half his money back today.
