The Trump administration says Native Americans might need to get a job if they want to keep their health care — a policy that tribal leaders say will threaten access to care and reverse centuries-old protections.

Tribal leaders want an exemption from new Medicaid work rules being introduced in several states, and they say there are precedents for health care exceptions. Native Americans don’t have to pay penalties for not having health coverage under Obamacare’s individual mandate, for instance.

But the Trump administration contends the tribes are a race rather than separate governments, and exempting them from Medicaid work rules — which have been approved in three states and are being sought by at least 10 others — would be illegal preferential treatment. “HHS believes that such an exemption would raise constitutional and federal civil rights law concerns,” according to a review by administration lawyers.

Trump challenges Native Americans’ historical standing

There is a law specifically protecting Native Americans from having their health care revoked. It has been established over the past hundred years that Native tribes are sovereign nations under U.S. protection, clearly and thoroughly. Good luck getting that dismissed. (But actually, I hope he has terrible luck, because that law shouldn't be dismissed, as doing so would be unconstitutional, as well as pointlessly cruel.)

Good write-up on the takedown...

At any point if the cop had fired and killed the suspect, the public, his peers, the press, even the driver himself, everyone would have understood. In fact, we likely would have called him a hero.

What held his finger? Bravery? Training? Compassion? Perhaps we will find out in the days ahead. But whatever it is, it deserves attention.

It is easy to take a life. A quick turn of the steering wheel and 10 people are gone. A small amount of pressure on the trigger, and the suspect is dead. We kill each other out of hate, or fear, or ignorance, or duty. Sadly, we understand this instinct well. This is the dark side of humanity. And rightly, we are mesmerized by the horror of it.

But there is light inside us too. We also possess the instinct to keep each other alive. This part of us can be more difficult to understand. But it deserves our devotion much more than the act of killing does. These moments of humanity are not uncommon, but they are precious. It would be good if we could remember that about Toronto, remember the cop who didn’t shoot.

Maybe David Suzuki could sell one of his eight houses to make up for the shortfall (at least temporarily).

On Thursday, a group of First Nations chiefs will gather in Kamloops to talk about the Kinder Morgan pipeline expansion.

But they won’t be discussing ways to stop it. They’ll be meeting to talk about ways to get it built. If you’re surprised by that, Chief Mike LeBourdais can relate.

“It seems like every time I watch the news, it’s about First Nations opposing the pipeline. But a lot of us understand it and support it,” he said.

“It includes retirement benefits for our elders and post-secondary education funding for our kids,” he said. “There are also opportunities for contracting and trades training for our community. And then there’s the tax revenue.”

Because the pipeline runs directly through the Whispering Pines reserve, the First Nation charges the company for the right of way. The existing Kinder Morgan pipeline generates about $300,000 a year. The company’s controversial Trans Mountain project would twin the pipeline and double the First Nation’s tax windfall to about $600,000 a year.

“We need that revenue,” he said. “If they shoot us in the foot on this, I’d like to know if that revenue will come from John Horgan.”
