I want Kovy/NHLPA to lose for two reasons.
First it would be in the best interest of the league as a whole. We all know if Kovy wins, then we will see a bunch of fake contracts with fake years on the end. Maybe 20. The whole reason for the last CBA was to stop this type of deal.

The second reason is purely bitter. I know the Kings were not even close to this type of contract when they "thought" they had a chance. I was on a cruise with players and management the weekend before the signing and all the PR people thought it was in the bag. All the players knew it wasn't. I think it would be funny if the NHL won and the Devils were given a cap hit that prevented them from signing him.

That being said, I don't think the NHL will win. The arbitrator they picked is a letter of the law type of guy and not a spirit of the rules type. This will be closed in the next CBA. I don't think the NHLPA will even fight it too much. After all it hurts all the players as well because they have to pay into escrow to cover Kovy's contract. I mean how would you like it if you had to pay 12% of your pay so that someone, who is making way more than you, in another department could get a raise?

I hope the NHLPA wins and Kovalchuk is awarded to the Devils at the deal proposed.
I do give props to the league for finally stepping up and trying to draw a line in the sand.
They should have done so earlier. What did they expect? As others have said before, if the NHL wins and gets authority over accepting and rejecting contracts, the issue will never be resolved. By the NHLPA winning, it will need to be addressed and the loophole will be closed. I expect that managers are taking note that the league took issue with this one and that while similar deals may be offered, nothing like the above posts will be offered. Those will surely be shot down. Did the DiPietro deal and Yashin deal work?
GMs know this is a risk but are willing to take it.
The thing I find funny is that the average league salary is WAY, WAY higher than before the lockout when they were "supposedly losing a ton of money". Yes, some franchises are still, but I find it humorous.

I was surprised the Devils gave Kovalchuk that contract. I thought it was completely out of character for Lou. I guess I was wrong.

from some of the sound bites I'd heard, it seems Lou wasn't the man in charge for these negotiations

in all honesty it most likely wont that much

the devils are beginning a bit of a youth movement...
over the next two years you will likely see up to 5 rookies in tedenby, josefson, henrique, urbom and corrente..... also likely are taormina and merril

next year langenbrunner, arnott and salvador all come off the books which is about 10 mil in salary,

not too mention if this deal goes through rolston, despite his NTC is likely on his way out.

I know some have said that a ruling against the NHLPA could prevent a sense of urgency in closing this loophole, but I'm going to take the optimistic road and say that this will be fixed in the next CBA. Neither side wants this kind of open-ended uncertainty in the rules.
