Most of the studios have a recorder rolling before the guest even enters the studio. They'll do all the on air stuff and archive the full thing so they can edit/piece it down as needed.

I fully believe this originated from Husker Sports Network studios. I really don't believe someone did this without a subtle nod from someone much higher up the food chain then they are. You don't snag audio off the studio network without leaving a little trail behind you.

If some jackass talent or engineer did this on his own then fuck that guy.

i just posted this in that other thread. but speaking to legality, unless it was one of the 3 people heard on the recording doing the taping, then the person that recorded it did it illegally. Hopefully that person gets some jail time or a fine of some sort. Not sure on the possible penalities because I didn't look them up.

Regarding the bolded, each state has it's own laws on recording a conversation. Nebraska's law is that as long as one person in the conversation is aware it's being taped, it is legal.

Regarding the legality of it being released to the media. It depends if it's a university employee or not, and if so do they have an employee agreement not to talk to the media without university consent? Many corporations have a clause that employees will refer media questions to Public Affairs dept.

So the individual could be fired under university policy, yes. But I doubt any legal action could be taken.

Of course there's more I don't know about the situation, who got it, how, who they worked for. I'm just saying there Could Be some issues. Everything that happens on the university they hold the rights to. They've made businesses change thier name cause the word husker was used

I know where you're coming from. Yet in this day and age what with emails, skype, cell phone cameras, twitter, what was Bo thinking? The only place sacred anymore is your own home. So, if need be, you can talk to your wife about this (unless she's about to divorce you) or talk to your best friend of 20 years (unless you're boinking his wife), but you DO NOT open your mouth where there's a high risk of what you say is going to come back and bite you in the ass.

It is regrettable that the tape got leaked, but I don't fault the "leaker" as much as I do the "leakee".
